One of the most interesting things about registering your business with CAC is that no other business in Nigeria, whether Business Name, Limited Liability Company or NGO can use the same name with you. Therefore, once a name has been approved for you, no other business can use that same name again in Nigeria.

If you find another business using that same name, know that it is not a registered business and you have the authority to ask that person to stop using the name. If he refuses and you take him to Court, he will face the law and pay damages to you.

Consequently, before CAC can register your business, you have to do what is called Availability Search. That is, you will have to submit two names and your personal information to CAC, to search and know if they have been registered before. If any of them has not been registered before, CAC will approve it for you to register.

CAC will search in their database to see if any company is already using the names. If not, they will approve one of them for you to register. You will then have a period of 60 days within which to register the name, otherwise the approval lapses.
